These Terms and Conditions (“Terms”) govern your use of BathBombPackaging.com and any quote, order, or purchase made through our website or sales channels. By using our site or placing an order, you agree to these Terms.
1) Quotes and pricing
- Quotes are based on the specifications you provide (size, material, finish, printing, quantity, inserts, shipping, and timelines).
- Quotes may be valid for 7 days unless stated otherwise.
- Pricing may change if specifications change, files require extra work, or market costs change (materials, freight, or supplier pricing).
2) Custom and made-to-order production
Most items we provide are custom manufactured based on your approved specifications. Because of this, custom orders may not be returnable except as described in our Return and Refund Policy.
3) Artwork, files, and approvals
- You are responsible for providing correct artwork and content (text, spelling, claims, barcodes, compliance, etc.).
- If we provide a digital proof, you must review and approve it before production.
- Once you approve a proof, you accept responsibility for the final output matching the approved proof, subject to normal production tolerances.
Color and print variation:
Colors may vary due to screen settings, print methods, paper materials, coating, and batch differences. Exact color matching is not guaranteed unless you select and pay for an approved color-matching process (for example, Pantone matching if offered).
4) Turnaround times and shipping
- Production and delivery timelines are estimates and can vary due to order complexity, supplier capacity, file revisions, holidays, customs, or carrier delays.
- We are not responsible for delays caused by shipping carriers, customs, incorrect addresses, or events outside our reasonable control.
5) Payments
- Payment terms will be stated on your invoice or in your written agreement.
- We may require full or partial payment before production begins.
- You agree to pay all applicable taxes, duties, or import fees if they apply.
6) Cancellations and changes
- Orders can be changed or canceled only if production has not started.
- Once production begins, cancellations may not be possible, and you may be responsible for costs incurred (materials, plates, setup, labor).
- Any change request after proof approval may require a revised quote and timeline.
7) Intellectual property and your content
- You confirm you own or have the legal right to use any logos, trademarks, images, or designs you provide.
- You grant us permission to use your content only to fulfill your order (and for proofing/production).
- You agree to indemnify and hold us harmless from claims arising from content you provide that infringes third-party rights.
8) Product use and compliance
You are responsible for ensuring your packaging design and labeling comply with applicable laws and regulations for your products, especially where claims, ingredients, warnings, and safety notices apply.
9) Limitation of liability
To the fullest extent permitted by law:
- We are not liable for indirect, incidental, special, or consequential damages (lost profits, lost sales, business interruption).
- Our total liability for any claim related to an order will not exceed the amount you paid for that order.
10) Warranty disclaimer
Except as stated in our Return and Refund Policy, products are provided “as is” and “as available,” and we disclaim all warranties to the extent permitted by law.
11) Governing law
These Terms are governed by the laws of USA, without regard to conflict of law rules. Any disputes will be handled in the courts of USA, unless you and we agree otherwise in writing.
